Welcome to KARVE Lagree Fitness, operated by Karve Fitness LLC ("Karve Lagree Fitness," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of the KARVE Lagree Fitness studio, including any services, classes, programs, and facilities offered therein.

Acceptance of Terms

By accessing or using KARVE Lagree Fitness, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you should not access or use the studio.

Use of Services

You must be at least 16 years old to use KARVE Lagree Fitness. By using our services, you represent that you are at least 16 years old. If you are under 18, you may only use the studio with the involvement of a parent or guardian.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Karve Lagree Fitness is not responsible for third-party access to your account that results from theft or misappropriation of your account. Karve Lagree Fitness and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Children Under Thirteen

Karve Lagree Fitness does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.karve.fitness only with permission of a parent or guardian.

Onsite Childcare Services

We offer onsite childcare services for children who are at least 6 months old. Parents and guardians utilizing the childcare services must ensure that their child meets this age requirement. The availability of childcare services is subject to space and scheduling.

Membership & Class Packages

To access certain features of KARVE Lagree Fitness, you may be required to purchase a membership or class package. Membership fees, class packages, and any unused classes in a billing interval are non-refundable unless otherwise stated in writing by us.

Membership & Class Package Cancellation/Refund Policy

Written cancellation notice must be provided via email to info@karve.fitness at least 14 days prior to your next billing date for autopay memberships. Refunds will not be issued for any payments made prior to the cancellation request.

Cancellation and Rescheduling

If you need to cancel or reschedule a class or session, you must do so within the time frame specified by KARVE Lagree Fitness. Failure to cancel within the specified time frame will result in a loss of class credit and/or cancellation fee.

Photography, Videography, and Security Cameras

By attending KARVE Lagree Fitness classes, you acknowledge and agree that photos and videos may be taken during class. These images may be used for marketing, advertising, and promotional purposes, including social media, website content, and other platforms. You waive any right to review or approve these materials and understand that no compensation will be provided for their use.

For security purposes, KARVE Lagree Fitness operates surveillance cameras in designated common areas of the studio. By entering our studio and using our facilities, you consent to the use of these security measures and acknowledge that the footage is used solely for safety and security purposes.

If you have concerns about photography, videography, or security measures, please notify us at info@karve.fitness prior to participating in any activities at KARVE Lagree Fitness.

Health and Safety

By using KARVE Lagree Fitness, you acknowledge and agree that physical exercise involves inherent risks, including the risk of serious bodily injury or death. You agree to participate in classes and use equipment at your own risk and assume all responsibility for your health and safety.

Code of Conduct

You agree to abide by all rules and regulations posted at KARVE Lagree Fitness. This includes but is not limited to rules regarding attire, equipment use, and behavior. We reserve the right to refuse service to anyone who violates our rules or behaves inappropriately.

Links to Third Party Sites/Third Party Services

www.karve.fitness may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Karve Lagree Fitness and Karve Lagree Fitness is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Karve Lagree Fitness is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Karve Lagree Fitness of the site or any association with its operators.

Certain services made available via www.karve.fitness are delivered by third-party sites and organizations. By using any product, service or functionality originating from the www.karve.fitness domain, you hereby acknowledge and consent that Karve Lagree Fitness may share such information and data with any third party with whom Karve Lagree Fitness has a contractual relationship to provide the requested product, service or functionality on behalf of www.karve.fitness users and customers.

Intellectual Property

All content and materials available at KARVE Lagree Fitness, including but not limited to logos, trademarks, and instructional materials, are the property of Karve Fitness LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use www.karve.fitness strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Karve Lagree Fitness that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Karve Lagree Fitness or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Karve Lagree Fitness content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Karve Lagree Fitness and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Karve Lagree Fitness or our licensors except as expressly authorized by these Terms.

Third Party Accounts

You will be able to connect your Karve Lagree Fitness account to third party accounts. By connecting your Karve Lagree Fitness account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

International Users

The Service is controlled, operated and administered by Karve Lagree Fitness from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Karve Lagree Fitness Content accessed through www.karve.fitness in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Karve Lagree Fitness, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Karve Lagree Fitness reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Karve Lagree Fitness in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. KARVE FITNESS LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

KARVE FITNESS LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. KARVE FITNESS LLC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KARVE FITNESS LLC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF KARVE FITNESS LLC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Modification of Terms

Karve Lagree Fitness reserves the right, in its sole discretion, to change the Terms under which www.karve.fitness is offered. The most current version of the Terms will supersede all previous versions. Karve Lagree Fitness encourages you to periodically review the Terms to stay informed of our updates. Your continued use of KARVE Lagree Fitness after any such changes constitutes your acceptance of the new Terms.

Termination

We reserve the right to terminate or suspend your access to KARVE Lagree Fitness at any time for any reason without prior notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Idaho and you hereby consent to the exclusive jurisdiction and venue of courts in Idaho in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

WAIVER AND RELEASE OF LIABILITY

In consideration of being allowed to participate in any way in the activities, classes, programs, and use of equipment and facilities provided by KARVE Lagree Fitness, operated by Karve Fitness LLC ("Karve Lagree Fitness," "we," "us," or "our"), located in Eagle, Idaho, you acknowledge, appreciate, and agree to the following terms:

  1. I understand that physical exercise, including the use of equipment, is inherently risky and may result in serious bodily injury or death.

  2. I voluntarily choose to participate in the activities and use the equipment and facilities provided by KARVE Lagree Fitness, and I assume all risks associated with my participation.

  3. I understand that it is my responsibility to consult with a physician before participating in any exercise program or using any equipment at KARVE Lagree Fitness.

  4. I agree to follow all rules and regulations posted at KARVE Lagree Fitness and to abide by the instructions of the instructors and staff.

  5. I hereby release, waive, discharge, and covenant not to sue Karve Fitness LLC, its owners, employees, instructors, agents, and affiliates (collectively, the "Released Parties") from any and all claims, demands, liabilities, damages, or causes of action arising out of my participation in activities, classes, programs, or use of equipment and facilities at KARVE Lagree Fitness, including but not limited to negligence on the part of the Released Parties.

  6. I further agree to indemnify and hold harmless the Released Parties from any and all claims, damages, liabilities, costs, or expenses, including attorney fees, arising out of or related to my participation in activities, classes, programs, or use of equipment and facilities at KARVE Lagree Fitness.

  7. I understand and agree that KARVE Lagree Fitness may capture photographs or video recordings of participants during classes, events, and other activities for marketing, social media, advertising, or promotional purposes. I waive any right to inspect or approve the use of such materials, including any written or electronic copy that may accompany them, whether now or in the future. I further understand and agree that I will not receive any compensation for the use of these materials.

  8. I acknowledge that KARVE Lagree Fitness utilizes security cameras in shared spaces for safety and security purposes and consent to being recorded in these areas. Cameras are strictly prohibited in private spaces to maintain personal privacy. By continuing to use KARVE Lagree Fitness facilities or services, I accept this practice and release KARVE Lagree Fitness from any claims or liabilities related to the use of such recordings.

  9. I acknowledge that KARVE Lagree Fitness provides onsite childcare services for children who are at least 6 months old. I understand and agree that:

    • It is my responsibility to ensure that my child meets this age requirement.

    • The availability of childcare services is subject to space and scheduling.

    • KARVE Lagree Fitness and its staff are not responsible for any accidents or injuries that occur to my child while in the childcare area.

    • I am responsible for providing any necessary supplies or items for my child while using the childcare services.

    • I will inform the staff of any medical conditions or specific requirements of my child that might affect their participation in the childcare services.

  10. I acknowledge that sauna use at KARVE Lagree Fitness involves inherent health risks. I understand and agree that:

    • I use the sauna at my own risk.

    • I will consult with a physician before using the sauna, especially if I am pregnant, have cardiovascular issues, are taking certain medications, or have other health concerns, and will only use the sauna with prior medical approval.

    • I will only use the sauna if I am at least 18 years old, or with written consent from a parent or guardian if under 18.

    • Swimsuits are required at all times while using the sauna, and towels must be used to ensure hygiene and safety. Bare skin should not come into contact with the sauna surfaces.

    • It is my responsibility to leave the sauna immediately if I feel unwell, lightheaded, or dizzy, and to inform a staff member of any discomfort.

  11. I understand that this Waiver and Release of Liability is intended to be as broad and inclusive as permitted by the laws of the state of Idaho and that if any portion thereof is held invalid, the remainder will continue in full legal force and effect.

BY PROCEEDING, I CONFIRM THAT I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT AGREEING TO IT INVOLVES GIVING UP SUBSTANTIAL RIGHTS. I DO SO FREELY AND VOLUNTARILY, WITHOUT ANY FORM OF INDUCEMENT.
